1. Agreement to Terms

By accessing and using Crafted Call ("the Platform"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you do not have permission to access the Platform.

2. Platform Description

Crafted Call provides an online platform that connects artists with galleries, organizations, and exhibition opportunities through art submission management. Our services include:

• Call for art creation and management tools for organizations
• Submission processing and jury review systems
• Payment processing for submission and activation fees
• Digital gallery creation and artwork showcase features
• Communication tools between organizations and artists

3. User Accounts

Account Creation

To use certain features of Crafted Call, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

Account Types

Crafted Call offers different account types with varying capabilities:

• Artist Accounts: For submitting artwork to calls
• Organization Accounts: For creating and managing calls for art
• Juror Accounts: For reviewing and scoring submissions

4. Acceptable Use Policy

You agree not to use the Platform to:

• Upload or transmit viruses, malware, or harmful code
• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Harass, abuse, or harm other users
• Submit false or misleading information
• Attempt to gain unauthorized access to the Platform
• Use automated systems or bots without permission
• Circumvent payment requirements or fees

5. Content Rights and Licensing

Your Content

You retain all rights to the content you upload to Crafted Call. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to:

• Display your content within the Platform
• Share your content with organizations you submit to
• Create thumbnails and modified versions for display purposes
• Include your content in marketing materials (with attribution)

Content Standards

All content must:

• Be original work or properly licensed
• Not contain offensive or inappropriate material
• Accurately represent the actual artwork
• Comply with all applicable laws

6. Fees and Payments

Fee Structure

• Submission Fees: Set by organizations, paid by artists per submission
• Activation Fees: Paid by organizations to publish calls
• Transaction Fees: Applied to processed payments

Payment Processing

Payments are processed through Stripe. By using our payment features, you agree to Stripe's terms of service. All fees are non-refundable unless otherwise specified or required by law.

7. Intellectual Property

The Crafted Call platform, including its design, features, and content (excluding user-uploaded content), is protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our platform design or code
• Use our trademarks without written permission
• Reverse engineer or attempt to extract source code
• Create derivative works based on the Platform

8. Privacy and Data Protection

Your use of Crafted Call is also governed by our Privacy Policy. We are committed to protecting your personal information and handling it in accordance with applicable data protection laws.

9. Disclaimers and Limitations

Service Availability

Crafted Call is provided "as is" and "as available." We do not guarantee uninterrupted or error-free service. We reserve the right to modify or discontinue features at any time.

No Guarantee of Selection

Crafted Call does not guarantee that submissions will be selected or that calls will receive submissions. Selection decisions are made solely by the organizing entities.

Limitation of Liability

To the maximum extent permitted by law, Crafted Call shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Platform.

10. Indemnification

You agree to indemnify and hold harmless Crafted Call, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload to the Platform

11. Dispute Resolution

Any disputes arising from these Terms or your use of Crafted Call shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in San Francisco, California.

12. Changes to Terms

We reserve the right to update these Terms at any time. We will notify users of material changes via email or platform notification. Continued use of Crafted Call after changes constitutes acceptance of the revised Terms.

13. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may also delete your account at any time. Upon termination, your right to use the Platform ceases immediately.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
